Indeed, the whole online-backgammon-for-money business is heavily based on trust, regardless of all the fine print the server puts in their Terms and Conditions. You pay them a certain amount of money to play for, and if you accumulate a significant winning, you trust them that they will pay you back when you wish. What are you going to do if they refuse? What are you going to do if they should simply close the site? Go to Israel or wherever and file a lawsuit?
The people behind the servers know that this is not going to happen. The resources required for taking legal action is way out of reach for most people, and would in most cases cost more than what the server took from you in the first place. About the only thing a player can do is tell his/her story in internet forums, and this may actually help as we have seen lately. Bad publicity is also worth something.
As far as I know, there haven't been any money-based servers going bankrupt yet. If and when this happens, I'm quite sure all money players may have in their game accounts will be lost.
