I'm not sure where you copied that language from, but the actual statute (as codified at 31 USC 5362) says "a game subject to chance," as opposed to "a game predominantly subject to chance."

It's likely that the word "predominantly" was removed during the legislative drafting process precisely to address the issue of games like poker, backgammon, and others that are subject to both chance and skill. You could still try the legal argument, but it's much tougher given the actual language of the statute.
