In a typical tournament, who goes first is determined by the tournament director. :)

I don't think it matters, though. In football, who gets the ball first is determined by a coin flip, but it's still clearly an athletic contest rather than a game of chance.

I can't imagine a court ruling that chess is within the scope of the statute. Every game has SOME element of chance, even if it's the chance that Hurricane Katrina will blow the board over just as you're winning.
