Simply write the rules with two options and let the tournament promoter / club director / democratic vote of participants :) decide which to use.

I agree with the write it both ways idea and think I suggested that. However I don't agree with the idea that a set of rules intended to attempt to remove ambiguities and create clarity should start out by intentionally creating a situation where it is undefined what the rule is. Shall every two players sitting down at a board to play be required to discuss this first? What is the default if they fail to discuss? I don't agree that this is the way a set of rules should be left. There needs to be a default and then an option / common variant. In my opinion, it is more important to define a default, whatever it is, than to leave it open and ambiguous.
