If you're right then this is an interesting difference between chess and backgammon. In chess, the rules state that you must be given the opportunity to punch your clock after you've completed your move on the chessboard, and that your move is not considered completed until you have stopped your clock and started your opponent's clock; however, it is considered the player's responsibility to punch the clock and not the opponent's responsibility. In particular, if a player completes the move on the chessboard, but forgets to punch the clock, then the opponent is free to make his move.
For backgammon checker plays, it's clear that because there is no touch-move rule, there is no way to define the end of the move other than by the punching of the clock. So then it seems inevitable that the responsibility for punching the clock must fall (somewhat counterintuitively in my opinion) on the opponent and not the player.
Cube actions pose a slightly different case. I gather that there is (implicitly if not explicitly) a speak-move rule, so that verbally announcing your action and handling the cube accordingly is binding. You can't shuffle the cube the way you can shuffle checkers, or "shuffle" your cube decision out loud. If I were to follow my chess instincts, I would then put the responsibility for punching the clock on the player rather than on the opponent. You're telling me, though, that if both players fail to notice and proceed "normally," then the penalty falls on the opponent, despite the speak-move rule.
