Ruling

There are two answers to this question: 1) what the ruling should be under the current rules of the ABT, and 2) what the ruling should be if we have appropriate rules and guidelines.

Let me answer No. 2 first, as I am sure of that answer. I believe there should be something, either in the actual rules of tournament play, or in Guidelines for tournament players and directors (which I believe should exist and currently does not) that says: "Whenever there is a question as to how a ruling should be made, the ruling should tend to go against the player who initiated or caused the question, problem, or ambiguity."

In this case, the statement "take it" is ambiguous, and the actions of that party caused the problem, and the ruling should be that he/she did take the cube.

Now, to answer No. 1, what should the ruling be according to the current rules of the ABT: the ruling should be whatever the hell the tournament director feels like ruling in this case. There are no clear guidelines, and each tournament director is free to use his own judgment. Now, I do not advocate that rules remove this judgment for the tournament director or his committee to make judgements based on what they believe is fair, but if we have better guidelines to both protect the players and give the tournament director something to point to so that he can show the fairness and appropriateness of his ruling, the game would be improved greatly. Situations like this one would still happen, but the resolution is more likely to be fair and consistent from tournament to tournament.
