Are you sure you're not violating trademark by labeling this a BQ?

When I looked at this position, I did not realize he had a checker on the bar. [Obviously you had no way of knowing this] Therefore, bot's play did not make sense to me. BQ criteria is: "I don't understand bot's play." Correct? Or is there something else?
