This is quite an interesting suggestion that I hadn't heard before. It sounds like a logical solution in principle. However, in practice, one stumbling block may be that enforcing the time penalty will be a slight nuisance, enough that people will be tempted not to bother. Also, people who favor legal moves may feel that the penalty re-introduces some of the things they don't like about the current rules, namely the potential for profiting from an honest mistake by the opponent.
