Neil, I don't believe that the situation you describe is a "legal move" problem at all. The opponent moved legally and he didn't pick up the checker. How can you be sure if he missed the hit or simply forgot to pick it up?
Now, if he did tap the checker, clearly indicating that he hit it, and then he picked up his dice without putting the checker on the bar, again, there is no question that you have the right to insist that the checker is not hit. That is the proper interpretation of the rule.
This is exactly what happened in our chouette two years ago. MCG and I were in the box, and Albert, who was captain, and there were at least 4 others on his team, forgot to pick up the checker and picked up his dice, and then he immediately picked up the checker.
There were some with 2 cubes and some with 4 cubes, and of course there was a most interesting discussion that followed. As Matt and others will attest, even though Matt and I strongly believed we were well within our rights to insist that the checker was not hit (and it was an important hit that could turn the game around), I offered a settlement where Matt and I agreed to take far less than the game was worth on the assumption that the checker was not hit (but of course, more than we would be worth if we allowed the hit).
Unfortunately, in match play, you cannot make settlements, but I think this story illustrates that in spite of what the rules say, we are all interested in fair and reasonable play and good sportsmanship, and when you talk about issues such as this, there will ALWAYS be gray areas.
The people in my chouettes are my friends, and we play not just for the money, but for the comraderie and fun of playing. We all want to be fair.
In a tournament, I absolutely feel that the rules must be strictly followed in order to maintain the integrity of the event and your agreement to do all you can within the rules and fair play to win. You owe that to your calcutta teammates, if any, but to all involved. And I must admit, in a tournament, I certainly am more likely to cut some slack to a person I like and respect who has been a gentleman or lady than I would to someone like, well, you know.
