I fully agree with you. With a small constraint, that would be the atmosphere of the game and the previous behavior of the opponent. In case of a somehow misbehaving opponent I wouldn't make him aware of type 2 error if it is advantageous for me. Fortunately the overwhelming number of opponents are very nice guys.
