Instead of discussing this as an under-resign, shouldn't it be discussed like a unfavorable settlement proposal?
I mean, it's not like he's certain to loose at all, so he's giving up some wins as well. And even though he'll most probably loose something like 85-90% gammons here, the gammon losses only cost an additional 25% ME (where his wins gain him 50% ME).
In round figures, he might over the board (wrongly) think that he's giving up maybe 12% wins, to avoid maybe 70% gammons? Still an unfair settlement:
12%*75% + 30%*25% = 9%+7,5%=16,5% Match Equity
vs. a resign single = 25% Match Equity
So - it's a cheap shot for sure, but maybe not as cheap as outright cheating...
What makes this ironically funny, is that he progresses to win the game after his resignation is rejected. That you gotta love!

PS: To the people not agreeing with Phil on his interpretation of the current US rules, they CONTINUE after the cited part:
The Director will require the opponent to accept the offer when no outcome more favorable for him can occur; otherwise, the Director deems the offer invalid
