1. Two novices not on the clock might make such a deal, that is, never to use the cube, but as with agreements to use legal moves, it would not be enforceable. I don't see any compelling need to have the director prevent this arrangement, especially since he or she might not even be aware of it. If he or she does hear about it, it would be prudent to have someone officially advise the players that this deal has to be done on trust in the other player's word. Do they really want to continue on that basis? If they express the slightest doubt, the director should then and there redundantly release them from their unenforceable contract.
Above the Novice level, I can't imagine any two players making such an arrangement, but if they did, same deal, it could be done but not enforced. An Open or Advanced player would be opening such a huge can of worms by making such an arrangement that I doubt they'd even think of doing so.
2. How do the rules allow the settlements you describe, or any others? I am under the impression that current rules do not allow settlements during tournament matches. (And I am very sure they should not!)
