The difference is that in Herb's case the rule is clear, and in this case it is ambiguous.

Herb was condoning an illegal move, which the rules clearly allowed him to do, and in my opinion encouraged him to do as a legitimate way to win a match.

Is using a dead cube and illegal move? Is a 2 cube on a 2-away player's side actually a dead cube? The current ABT rules are not clear on this and you can find some tournament directors who would rule one way and some another.

I don't believe you should chastise anyone for following clear rules.

This ambiguity is just another example of why I have been arguing that the ABT rules should have been rewritten to eliminate ambiguities like this, but I have never been able to convince the ABT to change a single word.
