If your opponent gets a time penalty for an illegal move, then you may win the match. One of the big arguments by LM proponents has been that if the opponent makes an illegal move then "I don't want to win that way."

So while the mechanism for winning is different, the cause-and-effect is the same. If you use time penalties for a NLM, then you're winning on your opponent's accidental illegal move. Even if the time doesn't run out, playing short on time can indirectly lead to your winning a match "that way".
