I am not a lawyer, but I assume it would depend on the position selection - 100 random positions from last night chouette would not be copyrightable, but as a counterexample, 100 blitz positions to carefully demonstrate the importance of different factors in determining blitz play and strength would. The key question is the amount of useful information that is conveyed in the selection of the positions.
