what is copyrightable?

Right, I would call all those examples "objective analysis." So if you write those things and I write another analysis of the same position that contains the same observations, I don't believe you should prevail if you sue me for bogarting.
But, disclaimer, I'm not a lawyer, so take anything I say about this with appropriate salt. And there are related issues I can think of, e.g. if I directly copy the sections of your analysis that contain the objective analysis, so that it's not just the analysis but the prose that I reuse, can you then prevail if you sue me for bogarting? I don't know the answer to that. It seems that to some level, your stylistic creations of writing should be protected by your copyright, and I'll bet that to some level they are.
