Cube action ATS?

I wouldn't cube this for money or at a "normal" score, but here a four cube means blue has just enough to win the match and gammon losses are neutralized.
I see eleven market losers, or two more than What's-his-name's law requires, but there are many bad sequences. In any case What's-his-name's law only applies to initial cubes for money.
It's pretty clearly a take, and I doubt I'd think much about the cube OTB so I'll say hold since that's undoubtedly what I'd do in practice. Is it technically a cube? I won't be surprised if it is, but I'll stick with ND,
