LA Open brackets

Is it those who did not get a bye or those who were not eligible to get one? For example, suppose there were 16 in early start and 13 in late start. Of the four who make semifinals the 2 from early start of course did not get a bye and let's suppose that from the late start one got a bye and one did not. It sounds like the two from the early start have more equity than the one from the late start who also did not get a bye. It seems better to me that they should have the same equity.
