Aesthetics - I think that when players do that, it makes the board more difficult to assess - its purely selfish and personal to me. I have a harder time using the board for my own thinking when checkers are stuck in odd places. But, I accept that its my problem, and I dont say anything, ever, over the board about it. To each their own.
Penalties - I have no idea what a reasonable penalty could / should be - thats a very murky area. As soon as you formalize a penalty structure for certain events, then its becomes a game-able point, and introduces a complication that isn't entirely necessary. Repeat offenders need to be punished somehow, but I dont know how. But, in this example (checker left on the bar), the offended player should be capturing that, and is also equally at fault for allowing the illegal play.
Perhaps there are just nuances of legal moves and illegal plays that require experience to overcome?
Legal moves at present are a gentleman's set of rules. They are not a formalized function - i.e. there is no mechanism to formally enforce them (such as an alert when it happens). So, until legal moves is under a technical control solution, then I am not sure what penalties can be reasonable enforced.
