Wiki discusses how the Code of Federal Regulations is changed (below). I know you are familiar with the process; I am pasting it for those who are not, including myself. It seems clear that the public has a chance to review proposed changes. If there are changes that citizens disagree with, they can engage their representatives accordingly. Obviously, there is more to it than voting simply voting for our representatives once in a while.
Wiki: "Under the nondelegation doctrine, federal agencies are authorized by "enabling legislation" to promulgate regulations (rulemaking).[2] The process of rulemaking is governed by the Administrative Procedure Act (APA): generally, the APA requires a process that includes publication of the proposed rules in a notice of proposed rulemaking (NPRM), a period for comments and participation in the decisionmaking, and adoption and publication of the final rule, via the Federal Register.[2][3]"
