The picture of the second situation -- even the blow-up -- is inadequate to evaluate. To determine if it is flat one must view it from the side, not from above.
However, Ken, we know the answer. You answered your own question in your original description. You said it is 'fairly flat'. 'Fairly flat' is not 'flat'. It is cocked.
The rule states that a die must land flat on one or more checkers. The only exception is a die in the bowl of a dimpled checker. The rule is not ambiguous, the rule is not 'convoluted'. The rule is quite simple.
On a lighter note, you really need to invest in some precision dice. (teasing)
