My example was all the men were 4.0 and all the women were 5.0, so no top players if PR is the metric.

But to change the example to yours, the answer depends on the definition of "fair". I think there would be unfairness for the TD to announce at the draw that top players will be grouped/seeded. I don't think it would be unfair if that were made clear at the time of registration. (I would never play in a seeded tournament.) I can completely understand someone else considering that to be unfair. People differ about what's fair. That's one reason real life sucks some of the time.
