It's not that complicated. It happens on the crap table all the time, and it is virtually always obvious, even if there is a high degree of tilt, which side of the die is predominantly up. I certainly admit there might be a time where a dice is almost exactly on the edge that it is not possible, but that would be quite rare, and then of course, if you use the rule that it is a valid roll when it is clear which side is up, and if there is a doubt, or not clear, the roll goes over.
If both players cannot agree whether it is clear or not, then of course you would need a ruling.
I don't think it is possible to have any rule that would not require a ruling at some point if the players disagree...the point is with this rule, it would rarely happen. With the current rule, it not only happens a lot that you would need a ruling, but it happens a lot that the players have to stop and examine the dice and try to come to an agreement about it. Not worth it.
