in chess tournaments players are encouraged to notate all plays.

In chess tournaments self-recording is required. Self-recording matches by hand is more or less unfeasible in BG, and if someone could do it, they probably wouldn't want to.

if you want to liken it to professional athletes' performances being recorded, there MUST be a legal framework similar to the ones in place for those events and competitors

I'm no lawyer, but it makes a certain amount of sense to me. I do know that the case law precedent on chess games is pretty clear.
