As Greg stated, there are no formal rules on this in the U.S. As much as I like to have formal rules and policies, I really don't know how to do this for division play. I know people who have won intermediate events who have absolutely no chance in the open, and really should be allowed to play in intermediate.
Part of the problem is that the Open division encompasses a very large range of skills, from the best players in the world down to players that are likely to be classified as "advanced" (meaning they might play with a Snowie ER of between 6.0 and 8.0). In an ideal world, and some day when we get enough players, perhaps there will be a higher division just for the pros so that those between intermediate and pro have a reasonable chance to cash. If everyone who wins an intermediate event is forced to move up for the rest of their life, many will simply stop playing tournaments--several already have.
Maybe the answer is that if you win in intermediate you must play X number of tournaments in open, and if you don't cash in any, you can drop back down.
In the meantime, in answer to your ethical question, I believe it is everyone's responsibility to see that the tournament director is aware of players' records so that he can make an informed decision.
