Part of the problem is that the Open division encompasses a very large range of skills, from the best players in the world down to players that are likely to be classified as "advanced" (meaning they might play with a Snowie ER of between 6.0 and 8.0).
I believe there are players in the Open division who play worse than this.
Maybe the answer is that if you win in intermediate you must play X number of tournaments in open, and if you don't cash in any, you can drop back down.
Anyone can get lucky in a tournament, even a couple of tournaments. I don't have a good solution off the top of my head but winning and being forced to move up isn't fair in my opinion.
I agree that if the director isn't aware of someone's playing ability it's up to the players to inform the TD. As an example, I attended a tournament last year, ABT event, where the director/staff had no idea who I was. I went up to register and they asked me if I was in the intermediate. While we all know I should be, could you imagine if I had quietly entered and told nobody ... bet my Calcutta field would have went first.
