Of course - that's correct. The player was willing to leave equity on the table. Phil's offer recovered the equity giving some to the player and some to Phil, if he got any equity at all which isn't clear. Perhaps Rory's comment was meant to imply that the deal wasn't fair to Phil.

This is a good example of how poor a measurement "fair" can be. Since any cut would be more than fair to the player, the definition fails to yield a mathematical solution to the equation. Of necessity, fair involves the preferences of the observer. That's one good reason that everyone should mind their own business. The preferences of the inviduals involved need to govern, not those who would sit in judgement.
