But it does make me question playing legal moves only with an unscrupulous opponent who might only use the rule to their advantage
This has been a concern for many of those opposed to adopting a legal moves rule. Let's address this.
1. I maintain the vast vast vast vast majority in the bg tournament playing world (esp. in the US, I can't speak as much for other parts of the world not knowing them as well) are trustworthy in this respect.
2. Realize if you make an illegal move and either of you notice it it is to be corrected. So in the unlikely scenario where you make an illegal move, your opponent notices and you don't, your opponent wants to cheat you he still has to quickly decide if it was to his benefit or not and not have a human like reaction. Most people when they see an illegal move flinch somehow. (even a bad play sometimes) I've had it happen on more than one occasion where I was in the middle of making a bad play and my opponent balked. I put the position back and found the play I had overlooked.
I don't have any concerns if this becomes a rule and hope it does.
