Doesn't seem right that he would get the delay back.
Not sure I understand this. Are you suggesting that the rule regarding getting the delay back should be different depending upon who first noticed the illegal move? (Note: under US rules, player always gets another delay period when required by opponent to correct illegal play).
In either case, it is the opponent requiring its correction after the fact (as permitted by the rules), not the player. Legal moves simply means that the opponent will always require correction of every illegal move he is aware of. The player is simply making him aware of it by pointing it out.
You may have a valid argument that the delay should be forfeit, however that argument would apply regardless of whether legal moves was in effect.
