Some thought about the structure and goal of a given law and his rules.

The german law is based on groups of cases, with extracted rules how to operate over a similiar field. The american law is based on case-law. I think, the touch rule is favoured by the fans of a law, that will have a set of rules for all, where as the american law looks more for the individual justness for every single case. In other words: there is a tournament director.
Backgammon is a sociable game. It allows people with different backround and skill to have fun with each other. Insisting for touch-move and other things should be answered with: begging and hawkers prohibited.
Once upon a time i saw a very strong player, who said: "without shuffling, this game can't be played." It is the vision, and sometimes you need the different vision, to see the patterns. Backgammon is a pattern recognition game, beside other skills. So if someone exploits the shuffling for other goals, there is director time. And a last word. I never saw exhaustive speed shuffling by a pigeon rather by a player who could do it better and shuffled for other reasons.
The touch move rule touches the heart of the soul from our beloved game.
