I agree that your points are valid. I just don't think they are important enough to warrant the additional wording; that creates an exaggerated impression of complexity. There is a tradeoff between covering all bases and simplicity.
I think the revised introduction may already be overly verbose. If we happen to be using checkers or dice where the dark color might be reasonably interpreted either way (e.g., red/blue), or if my opponent somehow thinks that only one cocked die should be rerolled, so what? I'm content to let my him/her decide after the fact. It's not costing me any theoretical equity (and if any practical equity, it's very small). It's completely unlike a game situation where my opponent will hit an ace shot if he keeps the 1 and rerolls only the other die.
As I see it, this is a cooperative effort to quickly create a random NGS starting position. If my opponent is a first timer I'm happy to walk him through the procedure, and with a little practice it goes very smoothly.
