This "boost" was dated September of this year. You could argue(inconclusively) that the position in this opinion contradicts the position taken in April of this year("Black Friday").

In actuality, the law - which includes a 1963 Statute, a 2006 Statute and a smattering of state positions - is a goulash that needs an effort at principled clarification.
