This is of course bogus, and should never be ruled as "non-gin".

The player could also make an illegal move that the opponent could accept, and then you can never be gin anyway...

More interesting - XG thinks it's not gin, so it awards a "decision" for the move, thus a lower error rate. Thus, if you're playing a match with a PR bet, then you should decline an opponents offer to resign, if you still have a stack on the duece point - since you might roll aces to lower your PR :-)
