In Response To: Leading Federal Judge Rules That Poker Is a Game of Skill Not Covered by U.S. Gambling Act (Bob Koca)

The US Constitution makes no mention of gambling, thus by virtue of the 10th Amendment vests the privilege of permitting, regulating and/or controlling it to the States. The federal Illegal Gambling Business Act only applies to gambling that is illegal - i.e., is a violation of the law of a State or political subdivision in which it is conducted.
