In Response To: Leading Federal Judge Rules That Poker Is a Game of Skill Not Covered by U.S. Gambling Act (Havard Raddum)

The least they could have done is find someone who is an expert in game theory, who knows that a Nash equilibrium (mutual perfect play against the other strategies) in the vast majority of cases will involve mixed strategies in which actions are taken with a certain probability between 0% and 100%, and that hence the 'one hand' argument is silly.
