When we like the trial court's ruling, he immediately becomes "the learned court below". When we don't, he becomes the arbitrary and confused relic.
The "Illegal Gambling Business Act" is not a significant statute in the current atmosphere. It doesn't define any independent federal crime. It requires "a gambling business which
(i) is a violation of the law of a State or political subdivision in which it is conducted;"
The UIGEA and the Wire Act, and their confusing intersection, are the weapons the US has used in the large cases that effect online poker and offshore bookmaking. Those are the cases that attempt to relegate American adults to child status.
