The REAL difference between Intermediate and Open

Right now, in the US the decision is left up to each individual tournament director. Does that sound like a good idea to you?
Yes, that sounds like a good way to do it. There are two main differences between Open and Intermediate divisions:
1. The Intermediate division costs less to enter and, consequently, has smaller prizes.
2. Top players are not supposed to enter the Intermediate division so that non-"top players" have a better chance of getting a prize.
For Point #1, it is up to the individual (and his pocket book) which division he wants to enter. This applies especially to local players who want a fun weekend without spending a lot of money.
For Point #2, most top players will properly put themselves in the right division. For the borderline cases, it works best if you leave the final decision up to the Director. That way the TD can balance the divisions the way he wants (e.g., make one of the divisions an exact power of 2) by moving certain players up or down. TDs usually have a good feel about who are the strongest players.
As a practical matter, it doesn't make a lot of difference to your chance of winning if there are a couple players playing in the wrong division.
