How much you use isn't the only defining factor, and can vary. One really has to look at the copyright laws of any given jurisdiction under which the published work are governed to know what is allowable or not.

I'm going to cite an example of "Fair Use" (that is legal in North America) and allows you to effectively reuse an entire work in a derivative work and do so legally. The example is the movie Space Balls. It is a well known parody of Star Wars. Anyone who has seen Star Wars and then sees Space Balls will notice right away that the latter is a rip off. Interestingly enough, it is quite legal under "Fair Use" to use a complete body of work as source material and produce a new derivative work as a "Parody" without violating copyright law. Parodies are specifically covered under "Fair Use".

Unfortunately "Fair use" laws seem to vary around the world so what is allowed in one jurisdiction may not apply to another.
