Phil Simborg: In the event you believe your opponent is not being fair with this, or any rule, at least you have some guideline to point to. Your best recourse is to nicely remind your opponent that you don't believe he is following the guidelines properly, and you would appreciate it if he does. If he argues, refuses, or continues to roll in a manner that you believe is unfair, then you can and should call the director. Now, the director, in his impartial wisdom and experience, can determine how to best handle the situation, but at least now he also has some guidelines so that he will not appear to be highly subjective, and the guidelines he has will be the same as those by other directors around the world.
BAM! Right here, Phil could not have said this any better.
If you are playing in a tournament, and you think your opponent is not complying with some rule, how about you just assume he doesn't know the rule, or just got a little lazy, rather than assume he's maliciously violating the rule? Then you just remind him. "Hey Phil, could you shake those a little more next time?" Phil will just say, "Oh, sorry... it's a long tournament, I'm a bit tired and I got a little lazy, no problem man." End of story.
We need to get away from assuming malicious intent. Just because somebody breaks a rule or skirts it doesn't mean they're trying to get an edge on you.
Then, in the rare case you're playing some asshat, then there is a clearly defined rule that a tournament director can point to and say, "Hey Mr. Asshat, you do actually need to shake the dice three times. Please do so in the future. Thank you."
