"Assuming that the opponent hasn't made an error" doesn't need to be stated because it is always assumed in discussions of this sort. If one permits the possibility that the opponent will adopt a non-equilibrium strategy, then logically one should permit the possibility of adopting a non-equilibrium strategy oneself, that outperforms equilibrium against this particular opponent. And in that case, even if the opponent's first move happens to coincide with an equilibrium strategy, the optimal response (in the sense of the response that has the best probability of success against this particular opponent) may not be an equilibrium response.
