I only think the current rule might be better because "reaching for the cube" can't normally be proven. It's a rare instance where we have video evidence as we do here where we can clearly see the player make a reach for the cube. OtB with the only evidence being one player saying "He motioned for the cube!" if the other person says "No I didn't!" then we're really screwed as far as being able to rule on the situation.

As it stands, again, in this specific situation, if I was on a committee or TD and was able to view the video evidence, I would rule this was a double. That being said I agree 100% with how Roberto handled it and would not have called for a ruling myself either.
