Would you make an incorrect pass because of your opponent's time problem?

Three scenarios: the opponent is better than you, the opponent is worse than you, the opponent is about the same as you. Would you take the cube in any of those situations?
Clock setting: (a) 10 second delay, (b) 12 second delay. Would it matter? Also, there's exactly one second left of banked time.
Live or online: do any of your answers change if you're playing live and the dice have to be rolled (or baffle boxed)? do any of your answers change if you're playing online and the dice are automatically rolled?
What if PR mattered, e.g. BMAB or the UBC?
Finally, if you win the match only because you passed this cube and then complicated the next game(s) to help your opponent lose on time, would you be proud of your accomplishment or disappointed with yourself for exploiting the rules?
