Side pools should not be so large as to have this stuff seriously enter into players' minds. The side pool cost should be less than the individual entry fee and if there's 10 or more players in the SP it should be split two ways.

Madison entry was 250 and SP 100 and it was split 2 ways 70/30. Madison Badger Classic entry (love that stuffed badger in the trophy) was 400 and SP 200 and it was split two ways 70/30.

I once saw a big masters side event somewhere a bracket of 32 with an entry of 500 (perhaps 600) with a 200 SP with 26 players in it and $5200 to the winner of the SP ! Clearly that SP should have been split 2 or even 4 ways. The temptation for shenanigans would be less with splits. The greater the money that's involved on an all or nothing situation, the greater the chances for people to forget their good morals.
