Is there an exception for a gin position? Rule 5.1 allows one to concede a game at a certain level but does not allow one to claim a game at a certain level. But then what to make of "before he can validly claim the match"? If there is a gin position exception suppose that a player didn't claim right away when the flag fell but when he finally does it is then gin. it is not known exactly when the flag fell and if t was gin at that point. Could a kibitzer say?

"The loss is immediate and triggered by the out-of-time event itself."

There is an ambiguity to me involving the word "can" in "before he can validly claim the match" There was a Seinfeld episode in which Kramer was going to remodel his apartment in "layers". Jerry bet him that he couldn't do it thinking he would never go through with all the work. After a few days Kramer abandoned the plan and Jery wanted to collect but Kramer said he could do it but just decided not to. So in the wording of this rule does can mean that you just have the potential to claim the match or does it actually mean claiming the match which would include noticing the fallen flag. So can you do it includes having the awareness to notice.

I don't think the wording is as clear as you say. I think the rule should be that running out of time loses the match and if the clock help makes that clear then all the better. Not like chess where you must notice it yourself.

What about the following: At 2 away 1 away Crawford there had been a cube (with both thinking it is 4 away 3 away) and then the 2 away player won that game Later they both agree that is what happened. The cube is out of play so it should have been just a single point, so we now have also a scoring error by both players which they both agree on afterwards. Should it be fixed meaning the winner of the next game after that "crawford" game is the match winner?
