Just a gnubg.exe in the process list is probably a bit to easy (BTW: I'm not a windows guy, I just extrapolate what I know from my unix background), but you can probably detect which dlls are needed (gtk is e.g. unusual), the usage of the CPU (is a correlation between focus lost and CPU usage of the suspect processes), size or checksums. That's not fool proof but should be pretty easy if you have the resources of a big BG server. And as I said, with 2nd and 3rd PC and virtual PCs it can be tricked out easily, but you get at least the very simple minds.
Related to the always running instances:
I guess that most people would accept a polity request to close those programs for the obvious reasons.
