I am thinking that you must call the flag to claim the win. If your flag falls in a gin position tough beans, you still lose with the exception that it is a draw if your opponent has insufficient mating material. Is that all correct? What if the player does not notice the opponent's fallen flag and then his falls also?
There is no definition of a "gin position" in chess--it is often much more difficult to determine which positions are gin anyway as the number of legal variations can be quite large.
If your flag falls and your opponent has sufficient mating material, you lose.
If your flag falls and your opponent has insufficient mating material, it's a draw.
If you both flag, it's a draw.
If you flag and mate is on the board (regardless of whether you have hit the clock), you win.
If you are very low on time but in a position where you cannot lose by reasonable play and virtually the only way to lose is on time, you may claim a draw by insufficient winning chances, provided you haven't flagged yet.
