MCG: Do you believe that the rule should be changed?
RM: Absolutely not.
The director can walk over and say the match is over if he sees a flag down. Why should a player's failure to notice change that? Kibbitzers can alert the director to the situation so that he does so. Yes, as Sam points out, the opponent's screw up could allow the situation to change and cloud the question of who is the rightful winner vs. what the evidence now says, but the match is technically over when the clock falls.
Without it being clear and unambiguous that the player timing out first is the loser, we can have two players that simply agree ahead of time that they would rather not be bound by time controls and will simply both ignore the clock if it runs out. Nobody will claim. They'll actually be within their rights under such revised rules to keep playing for 5 hours at their leisure. Its one thing for people to disrespect the system and intentionally violate the rules, and if so, the director has something to deal with. It is another thing for the rules to say "its ok" because until someone opens their mouth and claims on time, the match officially continues.
