Fair enough, but this wouldn't have been my interpretation of the rules prior to reading this thread.

Without it being clear and unambiguous that the player timing out first is the loser, we can have two players that simply agree ahead of time that they would rather not be bound by time controls and will simply both ignore the clock if it runs out. Nobody will claim. They'll actually be within their rights under such revised rules to keep playing for 5 hours at their leisure.

I don't think this should be a consideration since it's obviously illegal...and there should be specifics on what happens if both people flag and it can't be determined who flagged first.
