I think the first situation is qualitatively different from the second. Passing at even-Post-Crawford is perfectly legal, albeit not very wise.
The second situation is an illegal move, and as Rich points out, even an impossible/invalid situation (though I am not sure whether there is a rules difference between the two). Personally, I almost always play "legal moves"--i.e., if someone makes an illegal move, I'll correct it--and hope, but don't expect, that others would do me the same courtesy.
Most of the things that Pat mentioned have come up in my games, esp. being closed out and then forgetting to roll instead of hit the clock. This is kind of a muscle-memory thing where you get so used to hitting the clock without rolling that you just continue to do it. I always let people roll when they do this. I even did this myself vs. Falafel in the master semis in NY; he let me roll. It's never come up for a TD ruling in my games, so I'm not entirely sure what it would be.
I always try to take the clock-newbie perspective on these things and help them out as much as possible. If someone forgets to hit their clock, I remind them. At least from a clock-advocate perspective it'd be fairly unwise to try to find an angle to increase your MWC this way. OTOH if I were in a chess tourney and my opponent made a move & forgot to hit his clock, I wouldn't see any problem with thinking & playing on his time, since he should really know better.
