I don't think it is as cut and dry as "I know this is technically wrong, but I'm doing it anyway". Sometimes you're just applying the Woolsey rule of "I'm not sure whether or not its a double, but I think there's enough chance my opponent may pass so I will double". In that case you might have misjudged the position, but you did not misjudge your opponent.
